Star67 operates this store and website, including all related information, content, features, tools, products and services, in order to provide you with information about our private restaurant and related experiences (the “Services”). Star67 is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, store, and disclose your personal information when you visit, use, join our waitlist, opt in to email or SMS marketing, make a purchase or other transaction using the Services, or otherwise communicate with us.
If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.
Personal Information We Collect or Process
When we use the term “personal information,” we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you.
We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:
- Contact details including your name, address, billing address, shipping address, phone number / mobile number, email address, and social handles you choose to provide (for example, Instagram).
- Marketing and messaging preferences including email marketing consent, SMS marketing consent, waitlist status, tags or segments associated with your profile, and records of opt-ins and opt-outs.
- Communications content including information you include when contacting us, submitting a waitlist or access request, or responding to our messages.
- Financial information including credit card, debit card, and financial account numbers, payment card information, transaction details, form of payment, payment confirmation, and other payment details (typically processed by Shopify and payment providers).
- Account information including username, password, security questions, preferences and settings, if you create an account.
- Transaction information including items you view, put in your cart, purchase, return, exchange or cancel, and your past transactions.
- Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services, and cookie / similar technology data.
Personal Information Sources
We may collect personal information from the following sources:
- Directly from you, including when you create an account, join the waitlist, opt in to email or SMS, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
- Automatically through the Services, including from your device when you use our products or services or visit our websites, and through cookies and similar technologies;
- From our service providers, including Shopify and messaging, analytics, hosting, and payment providers, when they collect or process your personal information on our behalf;
- From our partners or other third parties, where permitted by law.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
- Provide, tailor, and improve the Services, including to process waitlist requests, manage guest communications, process payments and orders (if any), remember preferences, and operate our website.
- Marketing and communications, including to send marketing, advertising, and promotional communications by email, SMS / text message, or postal mail where you have consented, and to show you online advertisements where permitted.
- Security and fraud prevention, including to detect, investigate, and help prevent security incidents and fraudulent, abusive, or illegal activity.
- Legal and compliance, including to comply with applicable laws (such as TCPA, CPRA/CCPA, and other privacy and telecommunications laws), respond to lawful requests, and enforce our terms.
- Business operations, including analytics, debugging, customer support, and internal reporting.
SMS / Text Messaging and Phone Numbers
This section explains how we collect, use, store, and share phone numbers and related data for our SMS marketing program (“Star67 Texts”), as required for SMS marketing with Shopify Messaging and applicable privacy and telecommunications laws (including the TCPA and, where applicable, CPRA).
How we collect phone numbers
We collect mobile phone numbers when you voluntarily provide them, for example:
- on our waitlist or other website forms;
- at checkout or other Shopify surfaces where SMS marketing consent is offered;
- by texting a published keyword to our messaging number (if we offer one); or
- by otherwise contacting us and providing a number for SMS.
Providing a phone number alone is not consent to receive marketing texts. We only send SMS marketing when you give separate, affirmative consent (for example, by checking an unchecked SMS opt-in box or completing another compliant opt-in flow).
How we use phone numbers and SMS data
If you opt in to Star67 Texts, we use your phone number and related consent records to:
- send recurring automated marketing text messages about Star67 (such as waitlist updates, table-release notices, event announcements, and related promotional or informational messages), subject to our Terms of Service;
- send transactional or service-related messages where permitted (for example, opt-in confirmation, HELP responses, or STOP confirmations);
- record and honor your opt-in and opt-out preferences; and
- maintain proof of consent (such as timestamp, source, and disclosure language) as required for compliance and carrier review.
Message frequency varies. Message and data rates may apply. Consent to SMS is not required to join the waitlist, make a purchase, or dine with Star67.
How we store phone numbers and related data
Phone numbers, SMS consent status, opt-out status, and related customer profile data are stored in our customer records on Shopify and with messaging providers that process data on our behalf. We retain this information for as long as needed to operate the Program, honor opt-outs, meet legal and carrier requirements, resolve disputes, and as otherwise described in “Security and Retention of Your Information” below. After you opt out of SMS, we retain enough information to suppress future marketing texts to that number.
Who we share phone numbers and SMS data with
We disclose phone numbers and SMS-related data to service providers that help us operate messaging and our store, including:
- Shopify Inc. and its affiliates, which power our store, customer profiles, marketing tools, and Shopify Messaging;
- SMS / telecommunications service providers and carriers engaged by Shopify or Star67 to transmit text messages;
- other processors that provide hosting, security, analytics, or customer support, under contracts that limit use of your information to providing services to us.
We do not sell your phone number as a standalone marketing list. We do not share SMS consent with unaffiliated third parties so they can text you for their own marketing, unless we clearly disclose that and obtain any required consent.
Your SMS choices
You may opt out of marketing SMS at any time by replying STOP to any Star67 text, or by contacting us at contact@star67.co. Reply HELP for help. Opting out of SMS does not automatically unsubscribe you from email unless you also unsubscribe from email (and vice versa).
How We Disclose Personal Information
We may disclose personal information to:
- Shopify and our service providers, to operate, secure, and improve the Services (including payments, hosting, analytics, email, and SMS);
- Partners and advertising partners, where permitted, including for analytics or advertising that may be considered a “sale,” “sharing,” or “targeted advertising” under certain U.S. state laws — see Your Rights and Choices and our Your Privacy Choices page;
- Professional advisors and authorities, where required or appropriate for legal compliance, security, or protection of rights;
- Business transfers, in connection with a merger, acquisition, financing, reorganization, or sale of assets.
Relationship with Shopify
Our store is hosted on Shopify. Shopify processes personal information to provide us with the Services, as described in Shopify’s privacy documentation. This includes customer profiles, checkout, marketing tools, and messaging infrastructure. Information you submit through the Services may be transferred to and stored on servers in the United States or other countries where Shopify or its subprocessors operate.
Third Party Websites and Links
The Services may link to third-party websites or services that we do not control. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies.
Children’s Data
The Services are not intended for children under 16 (or a higher age if required where you live), and we do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.
Security and Retention of Your Information
We implement measures designed to protect personal information. No method of transmission or storage is completely secure. We retain personal information for as long as reasonably necessary to provide the Services, maintain customer relationships (including waitlist and messaging preferences), comply with legal obligations, resolve disputes, enforce agreements, and for other legitimate business purposes. Retention periods may vary by data type and legal requirements (including SMS consent and suppression records).
Your Rights and Choices
Depending on where you live, you may have rights regarding your personal information, which may include rights to:
- Access the personal information we hold about you;
- Correct inaccurate personal information;
- Delete personal information, subject to legal exceptions;
- Portability of certain personal information;
- Opt out of marketing emails and SMS (as described above);
- Opt out of sale / sharing / targeted advertising under applicable U.S. state laws (including California’s CPRA), including via our Your Privacy Choices page or Global Privacy Control signals where recognized;
- Limit use of sensitive personal information, where applicable;
- Appeal a decision on a privacy request, where required by law;
- Withdraw consent where processing is based on consent (withdrawal does not affect prior lawful processing).
To exercise access, deletion, or other privacy rights, email contact@star67.co with your request and enough detail for us to verify and respond. We will not discriminate against you for exercising privacy rights.
California residents may have additional rights under the CCPA/CPRA. We will disclose categories of personal information collected, sources, purposes, and categories of recipients as required. For “Do Not Sell or Share My Personal Information” requests related to cookies and advertising, use Your Privacy Choices.
Complaints
If you have concerns about our privacy practices, contact us first at contact@star67.co. Depending on where you live, you may also have the right to lodge a complaint with a data protection authority or other regulator.
International Transfers
If we transfer personal information out of the European Economic Area, United Kingdom, or other regions with data-transfer rules, we will rely on recognized transfer mechanisms (such as Standard Contractual Clauses) or other lawful bases, unless the destination has been determined to provide an adequate level of protection.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the “Last updated” date, and provide notice as required by applicable law.
